1. DETAILED DESCRIPTION OF GOODS &/OR SERVICES:

Brushtox SA is a business in the oral hygiene industry that manufactures and markets Brushtox, the antiseptic toothbrush cleanser.

2. GENERAL RULES:

  1. Copyright of this website belongs to Brushtox SA Antiseptic Toothbrush Cleanser of Mossel Bay, Republic of South Africa.  The contents thereof may under no circumstances be duplicated or used without the formal consent of Brushtox.
  2. Brushtox takes no responsibility for mistakes, whether electronic or with regards to the contents of this website.
  3. Users may download, view and print content from this site for private and non-commercial purposes only.
  4. All rights of Brushtox and its employees/agents are reserved

3. SHIPMENT AND COSTS: 

  1. Shipment of the first order normally takes place within 20 (twenty) days after payment is received, and delivery confirmed by way of e-mail, but is subject to stock levels and external delays.
  2. Following shipments of orders normally takes place within 7 (seven) days after payment is received, and delivery confirmed by way of e-mail, but is also subject to stock levels and external delays.
  3. Products that are being sold on this website will be shipped only in South Africa and Brushtox will not take responsibility of products that are being shipped out of this area.  
  4. Brushtox however makes provision on special insistence and request, that the products be delivered outside South Africa, in which circumstances the shipping-charges thereof will be for the purchaser’s account.  Shipping time in such circumstances will accordingly be adapted.
  5. Brushtox reserve the right to decline any order.
  6. In instances where delay is due to the perpetrate of Brushtox, Brushtox undertakes in so far as possible to notify the purchaser.  

4. RETURN AND REFUNDS POLICY:

The provision of goods and services by Brushtox is subject to availability. In cases of unavailability, Brushtox will refund the client in full within 30 days. Cancellation of orders by the client will attract a 20% administration fee.

5. PRICE AND COSTS:

5.1 PRICE  
The price of every product is displayed on the website of Brushtox and incase of any special offer or clearance sales, the prices will accordingly be adapted on the website.

5.2 VALUE ADDED TAX (VAT)
The purchase price of each product includes SA Value Added Tax (where applicable) at the rate of 14% (fourteen percent).   

5.3 SHIPPING-CHARGES 

  • Shipping-charges to destinations in South Africa will be listed with the product price on the website and will depend on the destination as advertised on the website of Brushtox.

  • Shipping-charges to destinations out of South Arica will be extra costs depending of the destination.

5.4 IMPORTATION TAX               
In case Import Tax is charge on the goods, such will be charge to the account of the purchaser.              

5.5 PACKING AND INSURANCE       
Packing and insurance costs is included in the Shipping-charges as mentioned on Brushtox website.

6. PAYMENT METHOD: 

Payment may be made via Visa, MasterCard, Diners or American Express credit cards or by bank transfer into the Brushtox bank account, the details of which will be provided on request

6.1 CREDIT CARD PAYMENT   

Credit card acquiring and security

Credit card transactions will be acquired for Brushtox via PayGate (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy

Customer details separate from card details
Customer details will be stored by Brushtox separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za

6.2 OTHER METHODS OF PAYMENT                   
Brushtox makes no other provision for any other methods of payment, apart for the ones as indicated in 6.1 above. Brushtox reserve the right to consider special requests.

6.3 MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY 
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR) and must be free of bank charges

7. DISCLAIMER

  • Every effort is taken to ensure that goods arrive safely. Brushtox is not responsible for any loss, damage or breakages that may be incurred during the mailing, shipping or unpacking process.

  • Apart from the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act, neither Brushtox nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this web site or the services or content provided from and through this web site. Furthermore, Brushtox makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this web site are free from errors or omissions or that the service will be 100% uninterrupted and error free. Users are encouraged to report any possible malfunctions and errors to the person referred to in clause 1.

  • This web site is supplied on an "as is" basis and has not been compiled or supplied to meet the user's individual requirements. It is the sole responsibility of the user to satisfy him/herself prior to entering into this agreement with Brushtox that the service available from and through this web site will meet the user's individual requirements and be compatible with the user's hardware and/or software.

  • All items purchased from Brushtox are made pursuant to agreements with shipping and delivery agents and risk of loss pass from Brushtox to such agents upon delivery of any item to such carrier.

8. RESPONSIBILITY:      

 Brushtox takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods

9. TERMS OF SALE AGREEMENT:      

  • The Sale Agreement between Brushtox and the Purchaser shall only come into effect if and when:       

  • A credit card authorization is received from the issuing bank or, in the case of a deposit, an electronic transfer or any other payment method, the correct amount is reflected on Brushtox bank statement.

10.GOVERNING LAW:          

This site is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African Law.      

11. JURISDICTION:     

Any disputes arising between the parties from any agreement or transaction of whatsoever nature, will be decided by the High Court of Cape Good Hope.             

12. STOCK AVAILABILITY:     

Stock of all goods on offer as advertised on the Brushtox website are limited.  Brushtox shall take all reasonable efforts to discontinue the offer as soon as stock is no longer available.  However, should items still be offered after stocks are sold, Brushtox shall only be liable to refund monies where it is unable to fulfill orders at advertised prices. 

13. PRIVACY:

  • This site collects private information from users, such information shall not be disclosed to any third party unless agreed upon between the user and Brushtox or through due legal process. Users agree that Brushtox may, from time to time (less than once a month) communicate with users.

  • This site uses cookies to customise the site and make a user's experience more user-friendly. Cookies are an industry standard and cannot harm a computer in any way.

  • If the user activates the tick box on their account page, Brushtox may send the user occasional email messages with news and special offers. If the option is not activated, the user will only receive email concerning orders and delivery status.

14. SECURITY:

  • Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that Brushtox suffers any damage or loss.

  • The user allows Brushtox to take all reasonable steps to ensure the integrity and security of the Brushtox site and back-office applications.

15. CHANGES TO AGREEMENT:

Brushtox may, in its sole discretion, change this agreement or any part thereof at any time without notice.

16. DOMICILIUM:

This website is governed by the laws of South Africa and Brushtox chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 93 Bruns House, Mossel Bay 6501, South Africa.
